40-10-26. State reclamation plan and annual projects submitted to Secretary ofInterior -- Contents of plan -- Annual support and implementation requests -- Costs forproposed projects.
(1) The division will submit to the Secretary of the Interior a state reclamation plan andannual projects to carry out the purposes of this section.
(2) The state reclamation plan shall generally identify the areas to be reclaimed, thepurposes for which the reclamation is proposed, the relationship of the lands to be reclaimed andthe proposed reclamation to surrounding areas, the specific criteria for ranking and identifyingprojects to be funded, and the legal authority and programmatic capability to perform this work inconformance with the provisions of this chapter.
(3) The division shall have the authority to submit an annual application for the support ofthe state program and implementation of specific reclamation projects to the Secretary of theInterior. These annual requests shall include such information as may be requested by theSecretary.
(4) The division shall have the authority to provide annual and other reports required bythe Secretary of the Interior to accompany the annual request for support required in Subsection(3).
(5) The costs for each proposed project under this section shall include: actualconstruction costs, actual operation and maintenance costs of permanent facilities, planning andengineering costs, construction inspection costs, and other necessary administrative expenses.
