61-2f-303. Sales agents or associate broker -- Affiliated with principal broker asindependent contractors or employees -- Presumption.
A sales agent or associate broker may be affiliated with a principal broker either as anindependent contractor or as an employee. The relationship between sales agent or associatebroker and principal broker is presumed to be an independent contractor relationship unless thereis clear and convincing evidence that the relationship was intended by the parties to be anemployer employee relationship.
