78B-11-128. Venue.
A motion pursuant to Section 78B-11-106 must be made in the court of the county inwhich the agreement to arbitrate specifies the arbitration hearing is to be held or, if the hearinghas been held, in the court of the county in which it was held. Otherwise, the motion may bemade in the court of any county in which an adverse party resides or has a place of business or, ifno adverse party has a residence or place of business in this state, in the court of any county inthis state. All subsequent motions must be made in the court hearing the initial motion unless thecourt otherwise directs.
