§ 959. - /t Damages determined; payment
Within two years after final determination that necessity requires the taking, the commissioner of the department of environmental conservation may proceed to acquire the lands included in the survey as finally approved by the court. If the commissioner and the persons owning or having an interest in the lands agree on the amount of compensation to be paid, the commissioner may take possession of the lands and interests upon payment of the agreed compensation. If the commissioner and the persons owning or having an interest in the lands are unable to agree on the amount of compensation to be paid, and if the commissioner wishes to proceed with the taking, he shall proceed in the manner provided in sections 511 and 512 of Title 19.
