§ 909. Executor refusing trust, or not giving bond

A person named executor in a will who refuses to accept the trust or neglects to give a bond for twenty days after the probate of such will shall not intermeddle or act as executor. In case of such refusal to accept or neglect to give a bond, the probate court may grant letters testamentary to the other executors who are capable and willing to accept the trust. If the other executors will not give a bond, administration, with the will annexed, shall be granted to the person who would have been entitled thereto had the testator died intestate.
