2.2-104 - Delegation of powers.

§ 2.2-104. Delegation of powers.

The Governor may designate and empower any secretary or other officer in theexecutive branch of state government who is required to be confirmed by theGeneral Assembly or either house thereof, to perform without approval,ratification, or other action by the Governor any function that is vested inthe Governor by law, or which such officer is required or authorized by lawto perform only with or subject to the approval, ratification of theGovernor; however nothing contained in this section shall relieve theGovernor of his responsibility in office for the acts of any secretary orofficer designated by him to perform such functions. Any designation orauthorization under this section shall be (i) in the form of a writtenexecutive order, (ii) subject to the terms, conditions, and limitations theGovernor deems advisable, and (iii) revocable in whole or in part at any timeby the Governor.
