2.2-2427 - Definitions.

§ 2.2-2427. Definitions.

As used in this article, unless context requires a different meaning:

"Board" means the Virginia Public Broadcasting Board.

"Public broadcasting services" means the acquisition, production, anddistribution by public broadcasting stations of noncommercial educational,instructional, informational, or cultural television and radio programs andinformation that may be transmitted by means of electronic communications,and any related materials and services provided by such stations.

"Public broadcasting station" means any noncommercial, educationaltelevision or radio station that (i) is licensed and regulated by the FederalCommunications Commission as a noncommercial, educational broadcastingstation; (ii) is operated by a public agency or a nonprofit privatefoundation, corporation, or association; (iii) has offices and studioslocated in Virginia; and (iv) on or before January 1, 1997, was qualified toreceive or was the recipient of a Virginia community service grant or otherinstructional television service funds, or, after January 1, 1997, wasqualified by the Board to receive state funds under standards and criteriaestablished by the Board pursuant to § 2.2-2429, but shall not include anyinstitution of higher education that produces or transmits distance educationand other credit and noncredit television programs, unless such institutionrequests qualification as a public broadcasting station and the Boardapproves its request.
