§ 2.2-2902. Use of tobacco products by state employees.

No employee of or applicant for employment with the Commonwealth shall berequired, as a condition of employment, to smoke or use tobacco products onthe job, or to abstain from smoking or using tobacco products outside thecourse of his employment, provided that this section shall not apply to thoseclasses of employees to which § 27-40.1 or § 51.1-813 is applicable.
