§ 21-358. Failure of contractor.

If any contractor to whom the work or a portion of the work shall have beenlet shall fail to perform the same according to the terms specified in hiscontract, action may be had in behalf of the board of viewers against suchcontractor on his bond in the circuit court for damage sustained by the leveeor drainage project and recovery made against such contractor and hissureties. In such an event the work shall be advertised and relet in the samemanner as the original letting.
