25.1-419 - Reimbursement of owner for costs when condemnation proceeding is abandoned or denied.

§ 25.1-419. Reimbursement of owner for costs when condemnation proceeding isabandoned or denied.

The court having jurisdiction of a condemnation proceeding instituted by astate agency to acquire real property by condemnation shall award the ownerof any right, title or interest in such real property such sum as will, inthe opinion of the court, reimburse such owner for his reasonable costs,disbursements, and expenses, including reasonable attorney, appraisal andengineering fees, actually incurred because of the condemnation proceedings,if (i) the final judgment is that the state agency cannot acquire the realproperty by condemnation or (ii) the proceeding is abandoned by the stateagency. The award of such sums will be paid by the state agency that soughtto condemn the property.
