§ 28.2-810. Removal, transportation, etc., from polluted ground; penalty.

A. It is unlawful for any person to take, catch, transport, sell, offer forsale, remove, receive, keep or store shellfish from condemned areas, or relayshellfish taken from such areas, until the Commissioner of Marine Resourcesor his designee has issued a special permit. The permittee shall carry thepermit when engaged in such operation.

B. It is unlawful for any person to take or remove shellfish from privategrounds in condemned areas without written authority in his possession fromthe owner or lessee, in addition to the permit required by subsection A ofthis section.

C. It is unlawful for any person to transport, relay, or move shellfish fromcondemned areas after sunset or before sunrise, except by motor vehicleproperly sealed as required by § 28.2-812. It is unlawful to mix cleanshellfish and shellfish from condemned areas in the same cargo.
