§ 3.2-3929. Restricted use pesticides prohibited; exceptions; trainingrequired.

A. No person shall use any pesticide classified for restricted use unlessthat person: (i) has first complied with the certification requirements ofthe Board; (ii) is under the direct supervision of a certified applicatoron-site and training for certification as a commercial applicator orregistered technician; or (iii) is producing an agricultural commodity whileunder the direct supervision of a private applicator on property owned orleased by that private applicator.

B. The Board may specify by regulation the amount of training and servicerequired to qualify a person for each classification or subclassification ofcertification as a commercial applicator or registered technician.
