3.2-3935 - Definitions.

§ 3.2-3935. Definitions.

As used in this article, unless the context requires otherwise:

"Acceptable release rate" means a measured release rate not to exceed 4.0micrograms per square centimeter per day at steady state conditions asdetermined in accordance with a U.S. Environmental Protection Agency (EPA)testing procedure as outlined in the EPA data call-in notice of July 29,1986, on tributyltin in antifoulant paints under the Federal Insecticide,Fungicide and Rodenticide Act, (7 U.S.C. § 136 et seq.); or a lower releaserate if adopted by the Board as necessary to protect health or theenvironment.

"Commercial boat yard" means any facility that engages for hire in theconstruction, storage, maintenance, repair or refurbishing of vessels (otherthan seaplanes) or any licensed independent marine maintenance contractor whoengages in such activities.

"Marine antifoulant paint" means any compound, coating, paint or treatmentapplied or used for the purpose of controlling freshwater or marine foulingorganisms on vessels.

"Tributyltin compounds" means any compound having three normal butyl groupsattached to a tin atom and with or without an anion such as chloride,fluoride or oxide.

"Vessel" means every description of watercraft, other than a seaplane, usedor capable of being used as a means of transportation on the water, whetherself-propelled or otherwise, and includes barges and tugs.
