32.1-122.10:005 - Licensed agents; liability

§ 32.1-122.10:005. Licensed agents; liability.

No volunteer of any participating entity who is duly licensed to providehealth care services shall be liable for any civil damages for any act oromission resulting from the rendering of such services to a recipient of aprogram designated by the authority when such services are provided withoutcharge and within the scope of the volunteer's authority to practice and thevolunteer delivering such services has no legal or financial interest in theprogram to which the patient is referred, unless such act or omission was theresult of gross negligence or willful misconduct. The provisions of thissection shall apply only to noninvasive and minimally invasive procedureslimited to finger sticks and injections performed as part of health careservices. The provisions of this subsection shall apply to those appropriatevolunteers providing care during the time in which such care is rendered freeof charge.
