§ 32.1-138.2. Certain contract provisions prohibited.

No contract or agreement for nursing home care shall contain any provisionswhich restrict or limit the ability of a resident to apply for and receiveMedicaid or which require a specified period of residency prior to applyingfor Medicaid. The resident may be required to notify the facility when anapplication for Medicaid has been made. No contract or agreement may requirea deposit or other prepayment from Medicaid recipients. No contract oragreement shall contain provisions authorizing the facility to refuse toaccept retroactive Medicaid benefits.
