32.1-291.18 - Immunity.

§ 32.1-291.18. Immunity.

A. A person that acts in accordance with this Act or with the applicableanatomical gift law of another state, or attempts in good faith to do so, isnot liable for the act in a civil action, criminal prosecution, oradministrative proceeding.

B. Neither the person making an anatomical gift nor the donor's estate isliable for any injury or damage that results from the making or use of thegift.

C. In determining whether an anatomical gift has been made, amended, orrevoked under this Act, a person may rely upon representations of anindividual listed in subdivisions A 3, A 4, A 5, A 6, A 7, A 8, or A 9 of §32.1-291.9 relating to the individual's relationship to the donor orprospective donor unless the person knows that the representation is untrue.
