§ 33.1-168. Abandonment of road in area to be flooded for purpose ofmunicipal water supply.

Whenever any city or town which owns and operates a waterworks system for thepurpose of supplying such city or town and its inhabitants with water findsit necessary to enlarge its water supply, for the accomplishment of which itis necessary to impound the water of a stream without the corporate limits ofsuch city or town, by means of a dam erected in such stream, and theimpounding of the water thereof would result in the overflow, or flooding, ofa section or sections of a road or roads within the secondary system of statehighways, thereby necessitating the alteration and relocation of the road orroads and the council of the city or town shall by ordinance declare suchnecessity and that it is the intention of such city or town to comply withthe requirements of this article, as hereinafter set forth, the road proposedto be flooded may be discontinued and abandoned but only after the city ortown has complied with the provisions and requirements of §§ 33.1-169 through33.1-174.
