§ 33.1-200. Paying for damages sustained to personal property by reason ofwork projects, etc.

The Commonwealth Transportation Commissioner is authorized and empowered, inhis discretion, to pay and settle claims and demands against the Commonwealtharising as a result of damages sustained to personal property by reason ofwork projects or the operation of state-owned or operated equipment whenengaged in the construction, reconstruction or maintenance of the StateHighway System, unless said claims or demands arise as a result of negligenceof the person or persons asserting such claims or demands. Nothing hereincontained shall be construed as imposing any legal liability upon theCommonwealth to pay such claims or demands, nor as giving the consent of theCommonwealth to be sued in any action or suit to recover on such claims ordemands in the event the said Commissioner refuses payment of said claims ordemands.
