§ 33.1-208. Use of streams and lowlands obstructed by newly constructedhighways as fishponds or water storage areas.

Whenever any highway is being constructed and the highway is to pass over anystream or lowland the obstruction of which is necessary to such constructionor if the present highway construction can be utilized to provide a suitabledam for a fishpond or water storage area, then upon application of theadjacent property owner requesting that it be so used, the CommonwealthTransportation Board may permit such use, provided that such dam should besubject to the provisions of Article 14 (§ 33.1-176 et seq.) of this chapter,and any additional cost incurred thereby shall be borne by such propertyowner.
