§ 37.2-318. Behavioral Health and Developmental Services Trust Fundestablished; purpose.

There is hereby created in the state treasury a special nonreverting fund tobe known as the Behavioral Health and Developmental Services Trust Fund toenhance and ensure for the coming years the quality of care and treatmentprovided to consumers of public mental health, mental retardation, andsubstance abuse services. The Fund shall be established on the books of theComptroller. Notwithstanding the provisions of § 2.2-1156, the Fund shallconsist of the net proceeds of the sale of vacant buildings and land held bythe Department. The Fund shall also consist of such moneys as shall beappropriated by the General Assembly and any private donations. Interestearned on moneys in the Fund shall remain in the Fund and be credited to it.Any moneys remaining in the Fund, including interest thereon, at the end ofeach fiscal year shall not revert to the general fund but shall remain in theFund. Moneys in the Fund shall be used solely for the purposes set forth inthis article. Expenditures and disbursements from the Fund shall be made bythe State Treasurer on warrants issued by the Comptroller upon writtenrequest signed by the Commissioner.
