37.2-915 - Representation of Commonwealth and person subject to commitment; nature of proceedings.

§ 37.2-915. Representation of Commonwealth and person subject to commitment;nature of proceedings.

The Attorney General shall represent the Commonwealth in all proceedings heldpursuant to this chapter. The Attorney General shall receive prior writtennotice of all proceedings held under this chapter in which he is to representthe Commonwealth.

The court shall appoint counsel for the person subject to commitment orconditional release pursuant to subsection B of § 37.2-906 unless the personwaives his right to counsel. The court shall consider appointment of theperson who represented the person in previous proceedings.

All proceedings held under this chapter shall be civil proceedings.
