§ 38.2-3401. Forms of insurance authorized.

A. Accident and sickness insurance shall be issued only in the followingforms:

1. Individual accident and sickness policies; or

2. Group accident and sickness policies.

B. Pursuant to the authority granted by § 38.2-223, the Commission maypromulgate such regulations as may be necessary or appropriate to governinsurers' practices with regard to Acquired Immunodeficiency Syndrome (AIDS)or the presence of the Human Immunodeficiency Virus (HIV), includingadvertising practices, underwriting practices, policy provisions, claimpractices, or other practices with regard to individual or group accident andsickness insurance policies delivered or issued for delivery in theCommonwealth of Virginia and certificates or evidences of coverage, issuedunder any contract delivered or issued for delivery in the Commonwealth ofVirginia.
