§ 38.2-3402. Certification to accompany application.

A. Each application for an individual accident and sickness insurance policyshall contain a certification, signed by both the applicant and the agentsoliciting the insurance, to the effect that: "The undersigned applicant andagent certify that the applicant has read, or had read to him, the completedapplication and that the applicant realizes that any false statement ormisrepresentation in the application may result in loss of coverage under thepolicy." If the application is to be used in a solicitation where no agentis involved, the certification may delete the reference to and signature ofthe agent soliciting the insurance.

B. Subsection A of this section shall also apply to an application by anindividual for coverage under a group policy where individual underwriting isdone.

C. If the certification is wholly or partially inapplicable to a particularform of policy, the insurer may modify or omit the certification with theapproval of the Commission.
