§ 38.2-3407.6. Exclusion of podiatrist not permitted under certaincircumstances.

No podiatrist shall be excluded from participating in any preferred providerplan pursuant to this chapter or Chapter 42 (§ 38.2-4200 et seq.) of thistitle or health maintenance organization pursuant to Chapter 43 (§ 38.2-4300et seq.) of this title solely because such preferred provider plan or healthmaintenance organization requires that participating health care providershave active medical staff privileges or admitting medical staff privileges atspecified hospitals, provided that the podiatrist has a delineation ofprivileges that enables such podiatrist to perform the type of services thatare covered by the preferred provider plan or health maintenance organizationat the designated hospital or hospitals. The Commission shall have nojurisdiction to adjudicate controversies arising out of this section.
