§ 38.2-5808. Examinations.

A. In lieu of or in addition to making its own examination of an MCHIP andits health carrier, the Commission may accept the report of an examination ofthe health carrier or other person responsible for the MCHIP under the lawsof another state certified by the insurance supervisory official, similarregulatory agency, or the state health commissioner of another state.

B. The Commission shall coordinate examinations of an MCHIP and its healthcarrier with the State Health Commissioner's examination or review of thehealth carrier to ensure an appropriate level of regulatory oversight and toavoid any undue duplication of effort or regulation.

C. The Commission shall accept a current certificate of quality assuranceissued by the Department of Health as evidence of compliance by thecertificate holder with any provision in this chapter authorizing orrequiring assessment by the Department of Health, by the State HealthCommissioner, or pursuant to regulations promulgated by the State HealthCommissioner.
