§ 45.1-180.4. Exemption for restricted mining.

Any operator engaging in mining and disturbing less than one acre of land andremoving less than 500 tons of minerals at any particular site, is exemptfrom all mining permit fees and renewal fees and bond requirements of thischapter; provided, however, each person intending to engage in suchrestricted mining shall submit an application for a permit, a sketch of themining site and an operations plan, which shall be adhered to in accordancewith §§ 45.1-181 and 45.1-182.1. The Director shall approve the applicationif he determines that the issuance of the permit shall not violate theprovisions of this chapter.
