§ 45.1-193.1. Injunction prohibiting mining operation.

Whenever adverse ecological disruptions or the injurious effects thereofseriously threaten or endanger the health, safety, welfare and propertyrights of citizens of Virginia, and abatement is not feasible by theapplication of control techniques, the Director shall petition theappropriate circuit court for an injunction to prohibit further operations.Such injunction shall not relieve the operator from his duty to reclaim landspreviously affected according to the terms and conditions of this permit.
