45.1-248 - Performance of reclamation operations by Director.

§ 45.1-248. Performance of reclamation operations by Director.

In the event of forfeiture of a performance bond, in whole or in part, theDirector shall deposit the proceeds in the State Treasurer's office in aspecial fund to be used by the Director to complete the reclamation plan andother regulatory requirements pertaining to the operation for which theforfeited bond had been posted. The Director may use the resources andfacilities of the Division or he may enter into contracts for performance ofsuch reclamation with any individual, corporation, partnership, association,or any other legal entity, any soil conservation district, or any agency ofthe state or federal government. After completion of the reclamation andpayment of all costs and administrative expenses associated with thecompletion of reclamation, any additional funds from the forfeiture of thebond shall be returned.
