§ 45.1-250. Hearings.

B. All formal hearings shall be conducted in accordance with § 2.2-4020unless the parties consent to informal proceedings. When a hearings officerpresides, he shall recommend findings and a decision to the Director, whoshall then issue findings and a decision, unless he provides for the makingof findings and an initial decision by such hearings officer subject toreview and reconsideration by the Director on appeal as of right or on theDirector's own motion. Such regulations shall also provide for a reasonabletime in which such appeals shall be acted upon, which shall be in addition tothe period required for the making of the initial decision.
