45.1-268 - Hearing to determine amount of lien.

§ 45.1-268. Hearing to determine amount of lien.

Any party having an interest in the real property against which a lien hasbeen filed may, within sixty days of such filing, petition the court ofequity having jurisdiction wherein the property or some portion thereof islocated to hold a hearing to determine the increase in the market value ofthe land as a result of reclamation. After reasonable notice to the Directorthe court shall hold a hearing to determine such increase. If the courtdetermines such increase to be erroneously excessive, it shall determine theproper amount and order that the lien and the record be amended to show thisamount.
