§ 45.1-361.25. Standing when Director or Board fails to act.

Should the Director or Board fail to take enforcement action within ten daysof the Board's receipt of a petition alleging that the petitioner is or willbe adversely affected by a violation or threatened violation of any provisionof this article, regulation adopted thereunder, or an order of the Board, thepetitioner shall have standing to file a complaint in the appropriate circuitcourt. The Board, in addition to the persons who are violating or threateningto violate any provision of this article, regulation adopted thereunder, ororder of the Board, shall be made a party to any such action.
