5.1-146 - Violations and penalties.

§ 5.1-146. Violations and penalties.

(a) Any person knowingly and willfully violating any provision of thischapter, or any rule, regulation, requirement, or order thereunder for whicha penalty is not otherwise herein provided, shall, after proper proceedingbefore the Commission, and upon conviction thereof, be fined not more than$100 for the first offense and not more than $500 for any subsequent offense.Each day of such violation shall constitute a separate offense.

(b) Any person, whether carrier, shipper, consignee, or broker, or anyofficer, employee, agent, or representative thereof, who shall knowinglyoffer, grant, or give, or solicit, accept, or receive any rebate, concession,or discrimination in violation of any provision of this chapter, or who, bymeans of any false statement or representation, or by the use of any false orfictitious bill, bill of lading, receipt, voucher, roll, account, claim,certificate, affidavit, deposition, lease, or bill of sale or by any othermeans or device, shall knowingly and willfully assist, suffer or permit anyperson, natural or artificial, to obtain transportation of passengers orproperty subject to this chapter for less than the applicable rate, fare, orcharge, or who shall knowingly and willfully by any such means or otherwisefraudulently seek to evade or defeat regulation as in this chapter providedfor air carriers or brokers, shall be deemed guilty of a misdemeanor and uponconviction thereof be fined not more than $500 for the first offense and notmore than $2,000 for any subsequent offense.

(c) Any air carrier, or broker, or any officer, agent, employee, orrepresentative thereof who shall willfully fail or refuse to make a report tothe Commission as required by this chapter, or to keep accounts, records andmemoranda in the form and manner approved or prescribed by the Commission, orshall knowingly and willfully falsify, destroy, mutilate, or alter any suchreport, account, record, or memorandum, or shall knowingly and willfully fileany false report, account, record, or memorandum, shall, after properproceeding before the Commission and upon conviction thereof, be subject foreach offense to a fine of not less than $100 and not more than $5,000.
