50-73.16 - Execution by judicial act.

§ 50-73.16. Execution by judicial act.

If a person required by § 50-73.15 to execute any certificate fails orrefuses to do so, any other person, who is adversely affected by the failureor refusal, may petition any circuit court, with general equity jurisdictionin the city or county where the office of the registered agent is located, todirect the execution of the certificate. If the court finds that it is properfor the certificate to be executed and that any person so designated hasfailed or refused to execute the certificate, it shall order the plaintiff toprepare and file with the Commission an appropriate certificate.
