51.1-154 - Compulsory service retirement.

§ 51.1-154. Compulsory service retirement.

Any employer, subsequent to the employee's normal retirement date, mayprovide for compulsory service retirement upon a determination that age is abona fide occupational qualification reasonably necessary to the normaloperation of the particular business or that an employee is incapable ofperforming his duties in a safe and efficient manner. Any such determinationshall be made by the employer.
