§ 51.1-819. Adoption of article optional by counties, cities, and towns;appeal.

Any county, city, or town in this Commonwealth having a police department mayadopt the provisions of this article and establish a police officers' pensionand retirement board if the governing body of the county, city, or townadopts a resolution approved by a majority of all the members thereof, by arecorded yea and nay vote.

Upon adoption of a resolution and establishment of the police officers'pension and retirement board, the board shall be vested with all the powers,authority, and duties established under this article.

A member shall be entitled to an appeal of right to the circuit court of thecounty or city which has jurisdiction of the board from any action on anymatter in which the board has discretionary power.
