§ 54.1-2824. Declaration of trust in consideration other than money.

Within thirty days following the receipt of any personal property other thanmoney delivered pursuant to any preneed funeral contract, the personreceiving it, if title thereto is transferred, or the person making suchdelivery, if title thereto is not transferred, shall execute in writing adeclaration of trust setting forth all the terms, conditions andconsiderations upon which the personal property is delivered, which shall beacknowledged in the same manner as the contract and recorded in the clerk'soffice of the circuit court of the city or county in which the persondelivering the personal property resides; provided, that if such terms,conditions and considerations are contained in the preneed funeral contract,the contract shall be recorded.
