55-225.7 - Disclosure of mold in dwelling units.

§ 55-225.7. Disclosure of mold in dwelling units.

As part of the written report of the move-in inspection pursuant to §55-225.6, the landlord may disclose whether there is any visible evidence ofmold in areas readily accessible within the interior of the dwelling unit. Ifthe landlord's written disclosure states that there is no visible evidence ofmold in the dwelling unit, this written statement shall be deemed correctunless the tenant objects thereto in writing within five days after receivingthe report. If the landlord's written disclosure states that there is visibleevidence of mold in the dwelling unit, the tenant shall have the option toterminate the tenancy and not take possession or remain in possession of thedwelling unit. If the tenant requests to take possession, or remain inpossession of the dwelling unit, notwithstanding the presence of visibleevidence of mold, the landlord shall promptly remediate the mold conditionbut in no event later than five business days thereafter and re-inspect thedwelling unit to confirm there is no visible evidence of mold in the dwellingunit and reflect on a new report that there is no visible evidence of mold inthe dwelling unit upon re-inspection.
