§ 55-450. Easement for encroachments.

To the extent that any unit or common element encroaches on any other unit orcommon element, a valid easement for the encroachment exists. The easementdoes not relieve a proprietary lessee of liability in case of his willfulmisconduct nor relieve a declarant or any other person of liability forfailure to adhere to any representation in the public offering statement.
