§ 56-405.1. Agreements with Commonwealth Transportation Commissioner orpublic road authority representative for maintenance and repair of publicgrade crossings.

Whenever the Commonwealth Transportation Commissioner or representative ofthe appropriate public road authority determines that it is in the bestinterest of the public to assist a railroad in its grade crossing maintenanceand repair activities, he is authorized to enter into an agreement with therailroad company for the repair or maintenance of any crossing of a railroadand a public highway or for the sale of materials to the railroad company forthe repair and maintenance of any such crossing. Any such agreement shallprovide for the railroad company to bear the cost of the repair ormaintenance or material furnished and such other conditions as theCommonwealth Transportation Commissioner or representative of the appropriatepublic road authority deems necessary or advisable to protect the interest ofthe public.
