56-573 - Sovereign immunity.

§ 56-573. Sovereign immunity.

Nothing in this chapter shall be construed as or deemed a waiver of thesovereign immunity of the Commonwealth, any responsible public entity or anyaffected local jurisdiction or any officer or employee thereof with respectto the participation in, or approval of all or any part of the qualifyingtransportation facility or its operation, including but not limited tointerconnection of the qualifying transportation facility with any othertransportation facility. Counties, cities and towns in which a qualifyingtransportation facility is located shall possess sovereign immunity withrespect to its construction and operation.
