§ 59.1-207.32. Prohibited exclusion.

No collision damage waiver subject to this chapter shall contain an exclusionfrom the waiver for damages caused by the ordinary negligence of the lessee.Any such exclusion in violation of this section shall be void. This sectionshall not be deemed to prohibit an exclusion from the waiver for damagescaused intentionally by the lessee or as a result of his willful or wantonmisconduct or gross negligence, driving while intoxicated or under theinfluence of any drug or alcohol, or damages caused while engaging in anyspeed contest.
