59.1-335.10 - Liability to consumer.

§ 59.1-335.10. Liability to consumer.

A. Any credit services business which willfully fails to comply with anyrequirement imposed under this chapter with respect to any consumer is liableto that consumer in an amount equal to the sum of:

1. Any actual damages sustained by the consumer as a result of the failure;and

2. Such amount of punitive damages as the court may allow.

B. Any credit services business which is negligent in failing to comply withany requirement imposed under this chapter with respect to any consumer isliable to that consumer in an amount equal to the sum of any actual damagessustained by the consumer as a result of the failure.
