§ 6.1-295. (Repealed effective October 1, 2010) Prerequisites toinvestigations.

Before making an investigation as provided for in the preceding section (§6.1-294) as to any person not licensed nor an applicant for a license underthis law a formal order shall be entered by the Commission specificallydirecting the investigation to be made, commanding submission by the personwhose business is to be investigated, and setting forth all other detailsnecessary to clearness and certainty, and no such order may be entered exceptupon at least one affidavit, which may be given by any member of thepersonnel of the Commission or by any other person, or upon documentary data,or upon admissions of the person to be investigated, or upon any combinationof the foregoing, satisfactorily establishing, prima facie, facts sufficientto warrant the investigation provided for by § 6.1-294. But if the personinvolved consents to the investigation being made the foregoing requirementsmay be dispensed with and the investigation may be made upon formal orinformal direction of the Commission or by, or upon the direction of, theCommissioner.
