§ 62.1-250. State agency review.

Prior to the creation of a surface water management area, or the issuance ofa permit within one, the Board shall consult and cooperate with, and givefull consideration to the written recommendations of, the following agencies: the Department of Game and Inland Fisheries, the Department of Conservationand Recreation, the Virginia Marine Resources Commission, the Department ofHealth, and any other interested and affected agencies. Such consultationshall include the need for development of a means in the surface watermanagement area for balancing instream uses with offstream uses. Agencies maysubmit written comments on proposed permits within forty-five days afternotification by the Board. The Board shall assume that if written commentsare not submitted by an agency, within the time period, the agency has nocomments on the proposed permits.
