§ 62.1-90. Rejection of application; requiring applicant to modify plans.

If the Commission be of the opinion, from the evidence before it, that theprospective scheme of development is inadequate or wasteful or that theapplicant is financially unable to construct and operate the proposed dam andworks, or that it is prejudicial to the public interest, the Commission mayrequire the applicant to modify the plans for the development in such manneras may be specified by the Commission or the Commission may reject theapplication.
