63.2-1238 - Forwarding of petition; when investigation and report not required.

§ 63.2-1238. Forwarding of petition; when investigation and report notrequired.

A. Upon the filing of the petition, the circuit court shall forward a copy ofthe petition and all exhibits thereto to the Commissioner and to the localdirector where the petitioners reside or resided at the time of filing thepetition, or had legal residence at the time of the filing of the petition.However, in cases where a licensed child-placing agency has completed a homestudy, the petition and all exhibits shall be forwarded to the licensedchild-placing agency.

B. In parental placement adoptions where consent has been properly executed,no investigation and report pursuant to § 63.2-1208 is required. However, thecircuit court may order a thorough investigation of the matter and report inwhich case the provisions of § 63.2-1208 shall apply.
