§ 63.2-405. Provisions for determination of eligibility for medical care andmedical assistance; provision of social services; regulations.
The Commissioner shall, in compliance with the state plan for medicalassistance services, applicable regulations of the Board and other state andfederal law, provide for the determination of eligibility for medical careand medical assistance and social services required for (i) stateparticipation under Public Law 97 of the 89th Congress of the United States,approved July 30, 1965, as amended, and regulations of the Department ofHealth and Human Services; and (ii) other state and federal programs. TheCommissioner, subject to the state plan for medical assistance services,applicable regulations of the Board and other state and federal law, mayestablish policies, in the form of guidance documents, necessary to implementsuch functions, including safeguarding information concerning applicants andrecipients. An application for medical assistance services for a personadmitted to a State Veterans Care Center located in the Commonwealth may befiled and processed in the jurisdiction where such Care Center is located.
