64.1-199 - Disposition upon death.

§ 64.1-199. Disposition upon death.

Upon death of a married person, one-half of the property to which thischapter applies is the property of the surviving spouse and is not subject totestamentary disposition by the decedent or distribution under the laws ofsuccession of this Commonwealth. One-half of that property is the property ofthe decedent and is subject to testamentary disposition or distribution underthe laws of succession of this Commonwealth. With respect to property towhich this chapter applies, the one-half of the property of the decedent isnot subject to the surviving spouse's right to an elective share under §64.1-13.
