65.2-305 - Voluntary subjection to provisions of title; effect of taking out insurance or qualifying as self-insurer.

§ 65.2-305. Voluntary subjection to provisions of title; effect of taking outinsurance or qualifying as self-insurer.

A. Those employers not subject to this title may, by complying with theprovisions of this title and the applicable rules of the Commission,voluntarily elect to be bound by it as to accidents or occupational diseasesor both.

B. Every employer taking out a workers' compensation insurance policy, orqualifying as a self-insurer, shall be subject to all the provisions of thistitle, regardless of the number of employees or whether he is an employer offarm and horticultural laborers and domestic servants. Such employers nototherwise covered by this title shall be subject to this title only duringthe period covered by such insurance. Every employee of an employer who hascomplied with the foregoing requirements shall be subject to all theprovisions of this title except that executive officers may reject coverageas provided in § 65.2-300.
