§ 8.01-526. When forthcoming bond taken; property remains in debtor'spossession.

The sheriff or other officer levying a writ of fieri facias, or distresswarrant, may take from the debtor a bond, with sufficient surety, payable tothe creditor, reciting the service of such writ or warrant, and the amountdue thereon, including the officer's fee for taking the bond, commissions,and other lawful charges, if any, with condition that the property shall beforthcoming at the day and place of sale; whereupon, such property may bepermitted to remain in the possession and at the risk of the debtor.
